For the first time since 1988, Alberta’s Employment Standards Code is being amended. The Fair and Family-friendly Workplaces Act was passed on June 7th, 2017 and all amendments will take effect on January 1, 2018. The most significant changes are to overtime calculations, averaging agreements, rest periods, and leaves.

Key Changes Include:

  • Overtime
    • May be banked up to 6 months without a permit
    • Banked overtime is taken as time off at the ratio of 1.5:1
    • I.e. 4 hours overtime is compensated at 6 hours of standard wage.
    • Time off provided within 6 months of performing overtime.
  • Averaging Agreements
    • Previously called “Compressed Work Weeks”
    • Hours of work may be averaged (maximum 44 hours/week average) over a period of 1-12 weeks to determine overtime.
    • Entering averaging agreements will require the majority of affected employees or be in a collective agreement.
  • Rest periods
    • 30 minutes break (paid or unpaid) within every 5 hours of consecutive employment.
  • Leaves
    • Employees eligible for leaves after 90 days of employment.
    • Compassionate care leave entitlement is 27 weeks.
    • Maternity leave entitlement is 16 weeks.
