Unspecified “operational issues” occurring in Prairie & Northern Region have caused Transport Canada Headquarters to revisit some of the limitations placed on operators carrying out Class D operations in Canada – even for the upcoming season. HAC believes that the interpretation currently being applied by Transport Canada Headquarters and circulated to the regions are not supported by the words of the Standards. Ultimately, there is no way for HAC to challenge Transport’s misguided interpretation unless the matter ends up before the Transportation Appeal Tribunal of Canada (TATC) – following a challenge by an operator who has been violated by the Department.
